O2 Academy Gigs Competition

FULL TERMS AND CONDITIONS FOR THE NOHRLUND UK/ O2 ACADEMY GIGS INSTA PROMOTION

1. Promotion is open to residents of the United Kingdom who are aged 18 or over, except employees of either co-Promoter (Supermalt UK Ltd or Academy Music Group Limited) or members of their immediate family, agents of either co-Promoter, or anyone professionally associated with this promotion.

2. Promotion Period: The Promotion Period runs from 00:01 on 28 September 2023 until 23:59 on 30 November 2023 and is split into 2 promotions as follows:

Any forms completed after the end of the Promotion Period will not be accepted.

3. Maximum 1 entry per person into each promotion. Maximum one prize per person.

4. No purchase is required. Internet access and an Instagram account are required.

5. To participate: You must follow @NohrlundUK on Instagram until at least 15 November (entries into First Promotion) and 15 December (entries into Second Promotion).  Access the entry form at https://livenationamg.jebbit.com/lnyqvmwn?L=Full+Page&JC=Nohrlund+channels and complete the form with your personal details (full name, email address and Instagram handle) and the O2 Academy venue (from the list at the base of these terms) for which you would like to win tickets.  Entries will not be permitted after the end of the Promotion Period. Your entry will be submitted into the promotion which is open at the time of receipt of your entry. 

6. Prizes (2 winners in total): 1 winner from each promotion will win:
   
   a. O2 Academy venue gig tickets: Tickets for the winner and 3 guests to the winner’s choice of O2 Academy venue gigs from the range set out at the base of this document. Winner and guests must be 18 years old or older at the time of the prize.  No travel, accommodation or food allowance is included.  Winner and guests must comply with the terms and conditions of the O2 Academy venue when attending their prize or risk expulsion from that O2 Academy venue with no compensation.  Anything not specifically set out in this clause is not included in the prize. O2 Academy venue gigs are in high demand and are subject to availability.
   
   b. 8 bottles of Nohrlund cocktails: 8 x 180ml bottles, 2 each of Bramble (7.5 ABV), Expresso Martini (7.5 ABV), Passion Martini (7.5 ABV) and Mojito (7.5 ABV), at Supermalt UK’s discretion.  Delivery will be within 28 days of winner confirmation of postal address for delivery.
   
   
7. No element of the prize is transferrable and cannot be exchanged for cash. There is no cash alternative.  In the event of unforeseen circumstances, the co-Promoters reserve the right to substitute the Prize for an alternative of equal or greater value.

9. By taking part in this promotion all entrants will be deemed to have accepted and be bound by these terms and conditions.

10. Instagram: This promotion is not sponsored, endorsed or administered by, or associated with, Instagram.  By entering this promotion you agree to release Instagram from any and all liability connected with the promotion.  Any personal data you supply under this promotion is supplied to Academy Music Group Limited and not to Instagram.  Your use of Instagram to participate in this promotion is subject to the Instagram terms and conditions, here: https://help.instagram.com/581066165581870 

11. Winner Selection: All valid entries received before the end of the relevant promotion period will be submitted into a prize draw to be conducted by or under the supervision of an independent body within 3 working days of the end of the relevant promotion.

12. Winner notification: The provisional winners will be notified within 2 working days of the relevant winner selection by email to the account specified on the winning entry form.  A winner must respond to the email communication within 10 working days of the date of the email, confirming compliance with these terms and conditions, and confirming their delivery address (within the United Kingdom) for the cocktails.  The winner will be asked to confirm their top three desired gigs from the then-available list of gigs at their preferred O2 Academy venue, and the co-Promoters will endeavour to provide tickets to one of the winner’s preferred events (subject to availability). If the winner does not comply with this timeframe they will be disqualified and a reserve winner will be contacted.

13. Unclaimed Prize: If, despite the best efforts of the co-Promoters, the prize remains unclaimed after offering to at least three reserve winners, the co-Promoters shall not be obliged to allocate the prize but may declare it void.

14. Privacy: The co-Promoter and operator of the O2 Academy Venues (Academy Music Group Limited) (“Operator”) will collect and share your personal data with its co-Promoter (Supermalt UK) for the administration of the promotion and the auditing of the entries where necessary and for no other purpose unless we have your consent or unless you have opted-in to receive future marketing communications from that specific co-Promoter. With the exception of winner details set out in clause 16, your personal data will at all times be kept confidential and in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018 as applicable.

15. Your personal data as supplied during this promotion will be deleted not more than 3 months after the end of the relevant promotion. 16. Privacy – winner details:  The name and region of the winner of each promotion will be available by sending an email to team.nohrlund@yesmore.co.uk with “Nohrlund O2 Academy Winners” in the subject header to arrive between 6 weeks and 10 weeks after the end of the relevant promotion.

17. By taking part in this promotion all entrants will be deemed to have accepted and be bound by these terms and conditions.

18. It is the responsibility of the entrant to provide correct, up-to-date details when entering the promotion and on acceptance of their prize. The co-Promoters cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.

19. Bulk entries made from trade, consumer groups or third parties will not be accepted.  If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that participant’s entries into the draw in a way that is not consistent with the spirit of the promotion, that person’s entries will be disqualified and any prize award will be void.

20. Incomplete, illegal, misdirected or late entries, or entries not in accordance with these terms and conditions will not be accepted.  Proof of sending will not be accepted as proof of delivery. 

21. Neither co-Promoter will be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained in connection with this Promotion or accepting or using a Prize, except for any liability which cannot be excluded by law. Nothing shall exclude either of the co-Promoters’ liability for death or personal injury as a result of its negligence. Neither co-Promoter takes responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise. Neither co-Promoter is liable for any problems associated with internet or communication networks due to traffic congestion, technical malfunction or otherwise. Neither co-Promoter will be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent a participant’s entry to the promotion.

22. If an act, omission, event or circumstance occurs which us beyond the reasonable control of either of the co-Promoters (including war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation) and which prevents that co-Promoter from complying with these terms and conditions the co-Promoters will not be liable for any failure to perform or delay in performing their obligation and, if the co-Promoters deems it necessary, the co-Promoters may cancel or amend the promotion. The co-Promoters will notify entrants of any amendment or cancellation by updating these terms and conditions in the first instance.

23. In the event that the promotion is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of either co-Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the co-Promoters reserve the right to disqualify any individual who tampers with the entry process or does not comply with these Terms & Conditions and to cancel, modify or suspend the Promotion or invalidate any affected entries without any liability.

24. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

25. No correspondence will be entered into.

26. These terms and conditions are governed by English law and shall be subject to the exclusive jurisdiction of the courts of England and Wales unless you live in a different area of the United Kingdom in which case your local laws will apply and your local courts will have jurisdiction.
